I thought the same thing, but I took another look ... the bike has a flag. It's at a point where flags aren't seen until its too late.
I made my heart pound, that's for sure.
Flags are required and we both had them, not that they helped in this case.

Flags don't help anything unless you're on mostly flat ground.
They especially don't help when most of the time they're leaning back from wind resistance and gravity going up a hill.
True, flags don't really help duners, just income for the BLM
