Well he already sent the majority of my parts back and all he had was my cylinder head but I had someone else's and I'm pretty sure he needed it back but I'm not sending it till I get mine.

Yeah im pretty sure he sold most my motors/parts already. He did run an ATV salvage after all.

Monday is my meeting with the Detective. I have to bring video from my surveillance system. Yes i keep all my data stored on external hard drives. So i have proof he did indeed take my motors from New York State.

Yeah, but he said he wouldn't sell any of the parts until my motor was done. I have the messages if you would like to see.

He also told me just last week he had it all still and would send it back for 50$ a tote. So i asked to see pictures of it all. Yet he can't get me pictures, but was fast to ask for shipping money?

If that doesn't found fishy then i don't know what to tell you.

I don't need to see messages but I can tell you what the detective will tell you. You entered into a civil agreement for services and payment was engines you'll have to resolve the issue in small claims or civil court. I'm willing to bet Matt still has your engines if he's willing to ship them back. I also know he's about broke so would need money for the shipping because since you're asking for all your stuff back why would he pay to ship it back to you? That'd be like me paying someone money then asking them to pay $150 to return my money and the stuff they were supposed to work on.

Ok first of all. I told him i would pay for return shipping the second he provided me with a picture of all my stuff.

Second of all. Yeah we agreed on a deal. He also told me it would take one month. His deal to me was one month. I even paid for parts. 200 dollars worth.

So if he cant even supply me a picture of my 3 motors and the 200 dollars of parts i paid for, why on earth would i keep sending him money for false promises?

As for the detective. I will still try that route. He took the motors from my house. On a verbal and written deal we had online. Its all in text. He hasn't made good on the deal. In fact its pretty much theft at this point. I have no updates or proof hes even touched the one motor. I have no proof he actually ordered my parts i paid for.

This whole thing can be over. All he has to do is gather all my parts, take a picture. I will send him money to ship the stuff out. He never has to hear from me again. But, if he can't prove he has my stuff before Monday, i will be filing paper work out with the detective.

Ill see if I can get him motivated for you. And everything you just told me will land you directly in small claims or civil court. You have zero grounds for criminal charges and that's what the detective will tell you. I know it sucks but Matt didn't just come take your engines with or without your knowledge he took them based on the preface that services were due in return for the motors.

We will see,  i will pursue every option i have. Since the deal was made in New York State, He would need to show up for NY court. Now showing up puts a bench warrant out for your arrest, which does carry over state to state.

He could make this all go away by actually doing what he says he's going to do. Instead of lying like a child.

I'm sure they'll extradite him to NY for a civil suit bench warrant. I'm just letting you know as soon as you tell a law enforcement officer you had an agreement for services or a sale they'll direct you toward civil or small claims court. If you lie and make it out like theft took place when there was a civil agreement in place then your on the hook for filing a false police report.

I wasn't going to lie. I have to print our conversations out for the detective.

The theft comes in where he can't even provide pictures. The agreement was one month. Even after one month i was nice and kept talking to him and giving him time. Even recently i gave him more time just to come up with pictures? Also he hasn't shown me what my 200$s bought.

If he already took my other motors as payment. Then i want my complete motor NOW. Because the agreement was, he took the motors as payment. The service he contracted with me was suppose to take one month. Not months of lying and no communication.

If i have to go to small claims or whatever i will.

A few points to bring to the table.  Does anyone know if his business is structered as a corporation or is he just a dba?  How his business is structured will make a difference in all of this.  Let's assume Matt has a legit business as in paying business taxes as Matt Hatfield Racing and is also set up as a corporation. He is going thru a divorce and she will most likley give the judge a story about how she was a big part of the business and helped build it blah, blah, blah.  Then she will either want part ownership or for Matt to buy her half of the business.  It's possible he is running the business into the ground to  either lessen the value of the business or he plans on making a train wreck of it then handing it over to her and laugh as he walks away.  Going on the assumption above that he has a structered corporation you will be taking Matt Hatfield Racing to court, not Matt.  As far as the law is concinered you made a deal with Matt who represents Matt Hatfield Racing.  As crappy as it is all he has to do is file bankrupt and any judgements against him are put on hold, the companies assets, if any are sold and the judge decides who gets how much if anything for the selling of the business assets.  It would be possible then to take Matt himself to civil court but depending on how his business was structured it would prob be a fruitless effort.  This is all assuming his business is structured as a llc.  Been thru something similar in the past as have a few friends.  I lost close to 5k in the deal.   I hope everybody in this deal comes out ok in the end.

Yeah, but my deal with Matt was before he even had his own business, that's how far back my deal goes with him. He picked up the motors around oct 2011.

So i would be taking Matt to court, not the business. Since he was an agreement/deal between two individuals ..

Hey at least I got you some pictures! Lol nothing there is criminal an agreement is an agreement. If one party takes longer than the agreed upon time or if one party completely fails to hold up there end all you have is a broken agreement. Nothing criminal, also it is against the law in most states, but I know for sure in Ohio and Kentucky (where Matt lives) to threaten an individual with criminal charges when you have no grounds for criminal charges. So in short the only one in this transaction between you and Matt that committed any criminal act is you. So you might want to slow down there batman with putting every detail of your plans in black and white on a public forum. I wish you the best man and I hope you get your stuff back soon. If you end up deciding to go the civil suit route good luck I've been through 3 of them where I was the plaintiff and won judgements in my favor. For close to $10k total have never seen a dime of it and wasted over $1500 chasing job info to attempt to garnish wages. Finally just said eff it and move on unfortunately civil law in this country has so very many holes in it it's pathetic.

I did nothing besides tell him what proof i have he was in New York and indeed take my motors. I have proof of every agreement he ever agreed to.

I tried being nice, i gave him more and more time. Then he turns around and shows his true colors. I have personal messages he sent people threatening them. I told him i either get my stuff back or i will see him in court. There is nothing illegal about it.

The guy is a real scum bag. Hes trying to send me motors/parts that aren't mine. Then claims i never sent a payment when i have proof.

Its pathetic some of you will still back this guy up. I hope those of you who still think Matt is doing nothing wrong eventually screws you over this big as well. Because more and more people are coming out of the wood works claiming he has stuff of theres and he wont return it.

Ha the fact you think I'm supporting Matt is funny. I was the first person to get loud about this **** and stir the pot and get everyone else to realize their parts had been gone for months. You threatened in this thread to file theft and Internet fraud charges against Matt are you that dense? That's illegal in most states. Like I said I hope you get your stuff back I'm happy I was able to help somewhat by getting Matt to send you some pictures of what I don't know but at least it was something.

I'm not backing him up.  I agree he hasn't done the right thing and stuck by his word in many cases.  My post was to intended to bring to light the legal route is far from easy, matter of fact it's a real pain in the ass and you may be left with nothing in the end.  The court system is designed to protect the defendant not the plaintiff any judge or lawyer will tell you that.  It's unfortunate but situations like this happen multiple times a day to many people and most often the innocent are left holding the bag.  If it were me I would go pick up my stuff in person.....much cheaper and less hassle.
